Wage garnishment is embarrassing because your employer knows about your problem. But even worse is that wage garnishment lowers your take-home pay. If you didn’t have enough to live on before the garnishment, after garnishment you will have even less.

Here’s how wage garnishment works:

  • You don’t have enough money to pay your bills.
  • Your creditor sues you and gets a judgment against you.
  • The creditor takes the judgment to your employer and has the employer take out 25% of your net take-home pay.
  • You can plead hardship to the court, but that may only lower the garnishment to 15%, at best.

If you cannot pay your bills before wage garnishment, you certainly can’t afterward.

You can stop wage garnishment by filing for bankruptcy – Chapter 7 or Chapter 13. Whether you pay some of your debt back in Chapter 13 or pay nothing in Chapter 7, both cases will result in a discharge of debts at the end of the case.
